- What is a divorce?
A divorce is the legal dissolution of marriage. If you’re legally married, you may be obligated to certain legal duties of your spouse (certain debts, etc…). A divorce separates those duties and cancels your marital status.
- What is an uncontested divorce?
An uncontested divorce is the simplest, cheapest, and fastest kind of divorce. There are 3 basic requirements you and your spouse may satisfy for an uncontested divorce.
- Husband and wife have agreed to a divorce and can reasonably negotiate the settlement of any property and debts.
- If there are children of the marriage, the parties will agree to custody and the standard visitation schedule as set out in the family code, although they will be able to set their own schedule.
- The parties will agree to child support amounts.
- How quickly can I get divorced/remarried?
In Texas, everything must follow a timeline. First I will file your Divorce Petition with the court. We must then wait at least 60 days, during which time we will attempt to come to an agreement between you and your spouse regarding property, debt, visitation, and child support. After the 60 day waiting period, we will go to court to present a Final Decree to a Judge. After the Final Decree is signed by the Judge, you must wait 30 additional days to remarry.
- Can I change my name in the divorce?
Yes. This is very common. There will be a provision in the Final Decree to change your name if you desire it. I will help you obtain a copy of the decree from the court so that you may show it to the relevant government agencies (Social Security Administration, Texas Department of Public Safety, etc…)
- What is child support?
Child Support is money paid by the non-custodial parent to the custodial parent for the maintenance of the child. In most divorce decrees, a section for child support is a necessary part of the document. Many judge’s will not sign a Final Decree unless there is a provision for child support in it.
- How much child support will I have to pay?
Generally, you’re required to pay a percentage of your net income, up to $6,000 per month. For 1 child, you’ll probably pay 20% of your net income (gross income minus taxes, union dues, and health insurance for child). For each additional child, an additional 5% of your net income will be calculated for child support.
- What is a Collaborative Divorce?
A collaborative divorce is similar to an uncontested divorce. In an uncontested divorce, while I will only be able to represent 1 client, both spouses benefit from their own ability to negotiate the terms of their divorce.
But in a collaborative divorce, the parties may not be able to negotiate so freely. In a collaborative divorce, each party has their own attorney to help them negotiate the terms of their divorce. The attorneys are paid only if an agreement can be reached. Once the agreement is reached, the parties go through the rest of the divorce process in the same way as they would in an uncontested divorce.
